Terms and conditions of sale

1. Services offered by the site

The Site offers the chance to benefit from web-to-photo services (the “Services”). To access the services, the user has to be registered to the Site. During the registration stage, the user will be asked to specify if they intend to register and therefore purchase goods as a company/professional or privately, specifying the user’s nationality. Only purchases made by private users will be subjected to the rules applicable to consumers. All final product prices viewed on the site are shown in Euros,  with or without VAT. Product prices are subject to periodic changes and variations. Shipping costs are considered as included for certain products and offers. For all the other products, the shipping costs will be paid by the user and well be display on the end of order process.

2. Services selection and purchasing method

After authenticated, the user can proceed to the selection of services as described in the relevant categories and sub-categories, selecting them from time to time, customizing, and adding the desired quantities in your shopping cart. The user is the only person responsible for products sent. After the selection of services desired, a screen will appear to confirm the order with all the details and the summary total amount.

3. Payments and loading of contents

The client will be able to purchase products online and carry out payments by debit/credit card (Visa or Mastercard) via Paypal, by bank transfer, as indicated on the site, by following the instructions indicated for the chosen purchase procedure. The necessary information for payment will be forwarded, by means of cryptographic protocols, to the payment institution which has been entrusted by 1PHOTO for electronic payments, without possibility of any third party having an access to the information. Payments must be made in advance and only after the payment is completed, the customer can send the goods to 1PHOTO.

4. User responsibility for uploaded content

The responsibility of products shipped 1PHOTO, and the acquisition of relevant authorizations to their photographic reproduction, where necessary, lies with the users. 1PHOTO shall in no way be held responsible for the production of photographic images not authorized or protected by copyright or third parties and any other type of violation of them existing. The user hereby releases 1PHOTO and also undertake to keep it free from any liability to third parties that might complain about violations of intellectual property rights, damage to the image, honor, dignity, integrity, moral or otherwise any pecuniary and non-pecuniary consequence of the photographic reproduction of products sent by the user. 1PHOTO reserves in any case the right to block any order that involves a clear violation of intellectual property rights of third parties or whose content is otherwise contrary to public policy or morality.

5. Delivery and shipping times

The date of completion of the order is displayed in the estimate and subsequently communicated via email upon shipment of products. The delivery dates are valid for most of a given national territory. The islands and remote areas could be served in two or more additional days. The order shall be deemed not completed until the time of payment and delivery of products by the user. If the user fails to ship products within 15 days from the date of payment of the order, the order will be canceled and the user will be refunded in case of payment confirmed. Receptions payment confirmations successive 18:00 is deemed to occur the next business day. In no event 1PHOTO be liable for any damage caused by the delay of the return of products.

6. Liability disclaimer

1PHOTO will not be liable to you for damages of any kind, arising from any errors of any kind, in the handling of products sent by the client, except malice or gross negligence. If errors are not attributable to the user 1PHOTO it will be held exclusively to rerun the photographs of the products. Upon delivery, the user must carefully examine the photographs received. Any defects of the photographs, errors of focus, and similar problems are not attributable to the user, they must be reported within a maximum of three days by sending an email message to support this service in 'Personal Area. 1PHOTO will do their best to respond to the reports received within hours.

7. Copyright

All photographs and videos produced by 1PHOTO are protected by copyright; The latter are to be understood as totally transferred (indefinitely and unconditionally) to the customer with the payment of the service. This means that if the payment does not take place within the predetermined due date, the client will no longer be able to use the photographs and there will be the legal conditions to proceed with the request for financial compensation for the illegal use of the photographs.

8. Withdrawal right

The right of withdrawal without penalties and without specifiying the reason, usually guaranteed to the “consumer” users, does not apply to most services offered by 1PHOTO, as the goods provided are personalised. The consumer will be able to withdraw from the contract within 14 days after the date on which the order has been completed. 9. Appicable law and jurisdiction for legal entities

The present conditions are subject to Italian law. For all orders from individuals who are not classed a “Consumer”, all disputes relating to the interpretation and/or execution of this contract will be under the exclusive jurisdiction of the court of Padova, Italy.
